Rights and obligations resulting from the termination of the Contract

  1. After the initial period of 30 days from the date of signing the Contract, and unless specific conditions for remaining in the network have been agreed upon, the Customer may freely and at any time terminate the respective Contract by notifying amigo, with a minimum notice period of 30 days.
  2. If the termination of the Contract occurs during the commitment period, the amount of all charges due to amigo for early termination shall not exceed the lesser of the following values:
    a) advantage given (offers and/or discounts) associated to the loyalty, in proportionally to the remaining loyalty period;
    b) a percentage of the monthly payments due, according to the following rules:
    • In the case of an initial loyalty period: 50% of the value of the outstanding monthly fees due, if the termination occurs in the first year of the contract; or 30% of the outstanding amount of the monthly payments due if termination occurs in the second year of the contract.
    • In the case of subsequent loyalty periods: if there is a change in the local loop installed, i.e. new installation, the same limits apply as for initial loyalty period (50% and 30%); If there is no change in the installed local loop, 30% of the outstanding monthly fees due will be charged.
  3. In addition to the above-mentioned values, the value of fixed equipment owned by amigo and lent to the Customer to ensure the provision of the service, which are not returned to amigo as stated in the Contract, may be added.
  4. Under the terms contractually established between the parties, the service shall be considered deactivated and the present Contract terminated, on the last day of the ongoing billing cycle at the time amigo receives the contract termination request.
